1. Overview
1.1 Bianza is a bill-splitting and payment platform operated by Darajapp LLC ("we", "us", "Bianza").
1.2 By using Bianza, you agree to these terms.
1.3 Bianza facilitates payments between diners and restaurants. We are not a bank, money transmitter, or financial institution. Payment processing is handled by Stripe.
2. Restaurant Accounts
2.1 Restaurant owners must provide accurate business information during signup.
2.2 You must connect a valid Stripe Express account to receive payments.
2.3 You are responsible for the accuracy of your table setup and QR code placement.
2.4 You may not use Bianza for illegal activity or to process payments for prohibited goods or services.
2.5 We reserve the right to suspend or terminate accounts that violate these terms.
3. Diner Usage
3.1 No account is required to use Bianza as a diner.
3.2 By participating in a session, you agree to pay your claimed share plus the Bianza service fee ($1.00 per person).
3.3 Payment is processed immediately and is non-refundable except in cases of error or dispute.
3.4 You are responsible for ensuring you claim the correct items.
3.5 Providing a false name or fraudulently joining a session you are not part of is prohibited.
4. Fees
4.1 Bianza charges diners a service fee of $1.00 per person per session, included in their payment.
4.2 Restaurants pay $0.00 in platform fees to Bianza.
4.3 Standard card processing fees (charged by Stripe) apply to the restaurant's connected account, same as any card transaction.
4.4 We reserve the right to modify fees with 30 days notice to affected users.
5. Payments and Payouts
5.1 Diner payments are processed via Stripe and flow directly to the restaurant's connected Stripe account.
5.2 Bianza does not hold diner funds at any point. Payments are direct from diner to restaurant.
5.3 Payout timing is determined by Stripe (typically 2 business days for US accounts).
5.4 Bianza is not responsible for payout delays caused by Stripe, bank processing, or account verification issues.
6. Disputes and Refunds
6.1 Payment disputes should first be raised with the restaurant directly.
6.2 If a dispute involves a Bianza service fee, contact support@bianza.io.
6.3 Chargebacks and card disputes are handled through Stripe's standard dispute process.
6.4 Bianza is not liable for disputes between diners and restaurants regarding food quality, service, or pricing.
7. Intellectual Property
7.1 The Bianza name, logo, and software are the property of Darajapp LLC.
7.2 You may not copy, modify, or redistribute any part of the Bianza platform without written permission.
7.3 Restaurant QR codes are licensed for use at the registered restaurant only.
8. Limitation of Liability
8.1 Bianza is provided "as is" without warranties of any kind.
8.2 We are not liable for: payment processing errors by Stripe, incorrect OCR extraction results, session disruptions, or unauthorized access to sessions.
8.3 Our total liability is limited to the service fees collected from the affected session.
8.4 We are not responsible for dine-and-dash situations where diners leave without completing payment.
9. Account Termination
9.1 Restaurants may delete their account at any time from dashboard settings.
9.2 We may suspend or terminate accounts for violations of these terms.
9.3 Upon termination, pending payouts will be processed through Stripe as normal.
10. Governing Law
10.1 These terms are governed by the laws of the State of Delaware, USA.
10.2 Disputes will be resolved through binding arbitration in the State of Delaware.
